Terms and Conditions

Welcome to NZ Kiwi Tour (“we”, “us” or “our”).
By booking a tour, activity or travel service through our website, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Bookings and Availability

All bookings are subject to availability and are not confirmed until payment has been received and a booking confirmation has been issued.
You are responsible for checking that all booking details are correct, including:

  • Name of the tour or activity
  • Date and time
  • Number of participants
  • Traveller names
  • Meeting point
  • Contact details

Once a booking has been confirmed, changes may be subject to availability and the conditions of the relevant tour or service provider.

2. Payment

Full payment must be made at the time of booking unless a different payment arrangement has been agreed with NZ Kiwi Tour.
Payments are processed securely in New Zealand Dollars (NZD).
The person making the booking is responsible for ensuring that the payment details provided are accurate and authorised for use.

3. Refund and Cancellation Policy

Bookings may be cancelled for a full refund if we receive the cancellation request at least 24 hours before the scheduled start time of the tour, activity or event.
Bookings cancelled less than 24 hours before the scheduled start time are non-refundable.
No refunds will be provided for cancellations made less than 24 hours before the scheduled start time, including cancellations due to:

  • Illness
  • Injury
  • Personal circumstances
  • Travel delays
  • Changes to travel plans
  • Failure to attend
  • Failure to arrive at the meeting point on time

The cancellation time will be based on the date and time we receive your cancellation request.
No payment-processing fee or administration fee will be deducted from an approved refund.

4. No-Show and Late Arrival

If you do not attend your booked tour or arrive after the scheduled departure time, you may be treated as a no-show.
No-shows and late arrivals are non-refundable.
You are responsible for allowing enough time to reach the designated meeting point. We are not responsible for missed tours caused by traffic, transport delays, incorrect directions or failure to arrive on time.

5. Changes to a Booking

Requests to change a booking may be accepted subject to availability.
Changes may include:

  • Changing the date
  • Changing the number of participants
  • Changing traveller details
  • Changing the selected tour or activity

Please contact us as early as possible if you need to change your booking.
If a requested change cannot be made, the original booking and cancellation conditions will apply.

6. Cancellations by NZ Kiwi Tour

We may cancel, postpone or modify a tour or activity due to:

  • Extreme weather
  • Safety concerns
  • Natural disasters
  • Road closures
  • Government restrictions
  • Operational issues
  • Supplier availability
  • Other circumstances beyond our reasonable control

If we cancel a tour before the scheduled start time, you may be offered one of the following options:

  • A full refund
  • Rescheduling to another available date
  • An alternative tour or activity
  • A booking credit

We will communicate the available options as soon as reasonably possible.
If a tour is cancelled, we will refund the amount paid for the cancelled service. Unless required by law, we are not responsible for additional expenses such as flights, accommodation, transport, meals, visa fees or other services booked separately by you.

7. Weather and Safety

Our tours operate in most weather conditions. However, the safety of our customers and staff is our highest priority.
We reserve the right to change, postpone or cancel a tour if weather, road or safety conditions make the activity unsafe or impractical.
The final decision may be made by NZ Kiwi Tour or the relevant tour operator.
If the tour is cancelled by us because of weather or safety concerns, you will be offered a full refund, rescheduling or another available option.

8. Traveller Responsibilities

Customers are responsible for:

  • Providing accurate booking information
  • Arriving at the designated meeting point on time
  • Following safety instructions
  • Following the instructions of tour guides and staff
  • Taking care of personal belongings
  • Ensuring they have all required travel documents
  • Informing us of relevant medical or mobility requirements

Customers must not participate in a tour while under the influence of alcohol or drugs where doing so may create a safety risk.

9. Health and Medical Conditions

Guests must inform us in advance of any medical conditions, disabilities, mobility issues, allergies or special requirements that may affect their participation.
Some tours or activities may not be suitable for all participants. We may request additional information to assess whether a tour can be provided safely.
We reserve the right to refuse participation where a person’s condition or circumstances may create a safety risk to themselves, our staff or other guests.

10. Behaviour and Removal from a Tour

All guests must behave respectfully and follow the reasonable instructions of our staff and tour guides.
We reserve the right to refuse service or remove a participant from a tour if their behaviour:

  • Creates a safety risk
  • Threatens or harasses another person
  • Damages property
  • Disrupts the experience of other guests
  • Breaches the law
  • Involves intoxication or drug use

A guest removed from a tour for these reasons may not be entitled to a refund.

11. Personal Belongings

Guests are responsible for their own personal belongings during the tour.
NZ Kiwi Tour is not responsible for lost, damaged or stolen personal items, except where liability cannot legally be excluded under New Zealand law.

12. Liability and Travel Insurance

Travel and outdoor activities may involve risks, including weather conditions, uneven surfaces, transport risks, physical activity and other hazards.
We take reasonable precautions to provide our services safely. However, guests participate in tours and activities at their own risk.
To the extent permitted by law, NZ Kiwi Tour is not liable for personal injury, loss, damage, delay or theft arising from participation in a tour or activity, except where such liability cannot legally be excluded or limited.
We strongly recommend that all customers obtain comprehensive travel insurance covering:

  • Medical expenses
  • Accidents and injuries
  • Personal belongings
  • Trip cancellation
  • Travel disruption
  • Emergency assistance

13. Third-Party Providers

Some tours, activities, transport services or accommodation arrangements may be provided by independent third-party suppliers.
Their own terms, safety requirements and operating conditions may also apply.
We will provide relevant information about third-party services where reasonably possible. However, the availability and operation of those services may be controlled by the relevant supplier.

14. Website Information

We aim to ensure that the information on our website is accurate and up to date.
However, tour descriptions, itineraries, schedules, prices and availability may change due to weather, operational requirements, supplier changes or circumstances beyond our control.
Minor changes to an itinerary do not necessarily entitle a customer to a refund.

15. Consumer Rights

Nothing in these Terms and Conditions is intended to exclude, restrict or limit any rights or remedies that cannot legally be excluded under applicable New Zealand law.
If a service is not provided as agreed or is materially different from the description given, please contact us so that we can investigate and attempt to resolve the issue.

16. Privacy

Personal information collected during the booking process will be handled in accordance with our Privacy Policy.
We may use your information to process bookings, provide services, communicate with you and manage customer enquiries.

17. Governing Law

These Terms and Conditions are governed by and interpreted in accordance with the laws of New Zealand.
Any disputes will be subject to the applicable courts and legal processes of New Zealand.
